Exit Permit is a Certificate issued by the FRRO in India. It is mandatory documents for foreigners who break the immigration laws.

If someone has overstayed in India, they need to pay a huge penalty to obtain an Exit Certificate from the FRRO and also face the consequences of breaking immigration laws.

  • Foreigners who have lost their Passport and Visa in India.
  • An OCI cardholder who lost their OCI card in India needs an Exit Permit to travel outside the country.
  • An Indian citizen who has acquired foreign citizenship must surrender their Indian passport and obtain an Exit Permit India to leave the country.
  • Foreigners who have stayed longer than their visa validity require an FRRO Exit Permit to travel outside the country.
  • Foreigners who are in court require an Exit Permit along with a Court Permission.

What Happens When you Overstay in India?

Foreigners who stay in India beyond their Indian visa expiry or who lose their foreign passport and visa during their travel in India need an Exit that issued by the FRRO in India.

  1. Hotels will not allow you to stay at the Hotel.Ā Ā 
  2. Your Phone SIM cards will be deactivated the day after your Indian visa expiry.Ā Ā 
  3. Your Indian bank account will be frozen by the Indian government.Ā Ā 
  4. You have to pay the penalty as per the duration of overstay in India.Ā Ā 
  5. Inform the police station ASAP.Ā Ā 
  6. If you overstay in India for a long time, then you can ask for a police clearance certificate.Ā Ā 
  7. Immigration authorities can deport you from the country.Ā Ā 
  8. Immigration authorities can blacklist them for a longer time.
  9. If you don’t leave the country after the notice from the FRRO, then they can put you in jail.Ā Ā 
  10. As per Immigration law Under the Foreigners Act, of 1946, those who overstay in India are deemed illegal migrants and can face a huge penalty, Blacklisting, and imprisonment of up to 5 years.Ā

Applicants need to prepare documents before applying for an online application. All the documents should be in PDF format, and the PDF size should not be more than 1 MB. Here we are sharing a Document Checklist for an Exit Visa Permit, which can give you an idea about it.

  • Applicant’s 51Ɨ51 mm light background passport-size photograph.
  • Applicant’s passport first and last page copies.
  • Applicant’s visa and immigration stamp page copies.
  • A copy of the surrender certificate.
  • A copy of the canceled Indian passport.
  • Loss of passport and visa FIR copy.
  • Copy of confirmed flight ticket.
  • A copy of the hospital discharge summary (only for a Newborn Baby).
  • A signed request letter from the applicant and a signed undertaking letter from the undertaker.
  • Applicant address proof in India like — Form C copy of hotel/house electricity bill/house landline telephone of the house owner in case of staying in a house of a friend or relatives. Along with a NOC letter and photo-identity card of the house owner.
  • Request Letter from the applicant.
  • Undertaking letters for Indian Passport holders in India.
  • Justification Letter from the Applicant — The applicant needs to mention the reason for overstaying in India and the travel plan.

FRRO officers can request additional documents from you based on your visa type, place of stay, and duration of overstay. Additionally, an expired Indian visa holder cannot apply for a Form-C.

Overstay fines in India depend on the overstay period as follows:

  1. A visa overstay in India of less than 15 days attracts a fine of around 500 INR.
  2. Visa overstays in India from 16 days to 30 days will result in a fine of around 10,000 INR.
  3. A visa overstay in India from 31 days to 90 days will result in a fine of around 20,000 INR.
  4. A visa overstay in India of more than 90 days will result in a fine of around 50,000 INR.
